What is FELA?

FELA, or the Federal Employment Liability Act assures railroad employees a safe work place and gives them and their families the right to recover compensation if injured in a railroad related accident. Under FELA, injured employees can seek compensation for wage loss, future wage loss, medical expenses and treatments, pain and suffering, and for partial or permanent disability. New FELA Lawsuit Filed by St. Louis Man

A lawsuit utilizing the Federal Employers' Liability Act (FELA) has been filed against the corporation CSX Transportation on behalf of ex-railway worker Ricky Lee Edsall, Sr. of St. Louis, MO.

Edsall's lawsuit makes the allegations that he was subjected to unsafe working conditions that included repetitive and dangerous situations involving several tools such as wrenches and sledgehammers.

According to the suit, Edsall suffered from serious repetitive stress injuries that resulted in him needing medical treatment. Edsall also claims that he was forced to walk on surfaces that were not kept up. The railway man also had to bend, stoop, and carry heavy materials for long distances. His work included crouching and kneeling while he worked on several types of machinery as well.

Under FELA rules, workers for railroad related industries could file lawsuits if they believe that their jobs were unsafe, or that they put them in harm's way. These jobs can include such benign seeming movements that can develop into lifelong problems for the workers.

Part of the suit also includes the allegation that CSX failed to hire enough staff to cover the work duties required of workers like Edsall.

The lawsuit directly accuses the company of failing to provide Edsall with a safe place to work, failing to provide sufficient workforce, failing to provide safe methods of work and failing to monitor the working area.
