What is FELA?

FELA, or the Federal Employment Liability Act assures railroad employees a safe work place and gives them and their families the right to recover compensation if injured in a railroad related accident. Under FELA, injured employees can seek compensation for wage loss, future wage loss, medical expenses and treatments, pain and suffering, and for partial or permanent disability. All railroad solvent exposure lawsuits have been filed under FELA.

FELA lawsuits filed in Madison County

-April 8, 2005

Two railroad workers have filed separate FELA lawsuits (Federal Employees Liability Act) in Madison County Circuit Court.

In one FELA lawsuit, Greg Marshall claims he sustained injuries while working for Norfolk Southern Railway for 23 years as a clerk. Marshall said he suffered injuries to his neck, back, spine and wrists by repetitive stress trauma while working for the railroad from 1968 to 2001.

The FELA lawsuit seeks at least $50,000 in damages claiming the railroad failed to provide a safe place to work, proper tools to perform the job duties and failed to provide warning that there could be repetitive stress injuries.

Alton & Southern Railroad has been named in another FELA lawsuit. Reno Eggleston, a switchman for the company, claims he was injured on Oct. 26, 2003 when his remote control device failed to timely engage on his locomotive, causing him to crash into another locomotive. Seeking at least $50,000 in damages, the FELA lawsuit was filed on April 7, the same day Marshall's FELA lawsuit was filed.
